Post subject: Bartender knew i was on meds and still served me |

| This happened back in may of 2000 so i dont know if i could do anything about it now but anyways...i was a bartender at this bar but didnt have to work that night and went there anyways... i was on an antidepressant and all in the bar knew this as i worked there...and i even told the bartender i didnt know if i should drink the drink because of the new antidepressant she gave it to me anyways... i dont remember anything the rest of that night.... i dont remember leaving the bar or rolling my car .... i woke up in the hospital screaming in a machine...various severe injuries...my blood alcohol level was wayyyy high ....i later talked to the bar owner and some of the bartenders and they said i was acting kind of funny but they kept serving me anyways....they said they tried to stop me from leaving also.....and i never got my job back..... can i sue them for my injuries (medical bills) or am i just stuck with it....as i feel that the bar and bartender are just as responible if not more than i..... |

| I wasnt a certified bartender the only training i had was from other bartenders i worked with...i didnt know any laws rules or regulations....i worked under others i beleive where certified...dont know if it makes a difference but.... |

If this happened in 2000, chances are you waited too long and the statute of limitations has passed. Even if there's still time to file a suit, there's also something called laches--this is a legal term meaning you sat on your rights for too long and waited till the last moment to file a lawsuit, and your case may be dismissed because of it. The only way around laches (assuming the statute of limitations has not expired) is to prove to the court that you could not file due to hardship or were under doctor's care the entire time and detail the reason you could not file.
Your questions should be addressed to a personal injury attorney with regard to the specific details of your case and the specific laws that govern the bar where this happened. It sounds to me like the first drink was your fault (it is not the responsibility of a bartender to know drug interactions, but strict liability falls on you for that). However, once you entered an intoxicated state, and the bartenders kept on serving you, those drinks were their fault, because it is illegal to serve someone who is intoxicated, and they intended to keep serving you to watch you for entertainment.
I'll repeat my advice of speaking to an attorney (many personal injury firms will give free consultation, and often over the phone). And be sure to include all the details you remember (anything you don't mention to your attorney could be used against you by the others' attorneys and you could lose your case).

I would have to say that if a doctor prescribed you the antidepressant or if you have taken them before the incident. The bar would have a very good case to say that you should have known for positive whether or not you could drink while on the medication.
This is one of those classic cases where a grown person should know what is expected of them. In mississippi we have a law on the books that makes it incapable for a drunk driver or the injured in a drunk driving incident to sue the bar that served the drunk boos.
If your old enough to go to the bar, unless you are an alcoholic, you should know your limit, know when to stop, and even know when not to start. |

You are the one that decided to go there and you are the one that drank . No body made you do that, so why would you blame anybody for that. The only thing that might be their fault is the fact that they over served you, but then again, they did try to stop you from leaving |

I have to completely agree with the last two posts. Take some responsiblity for your own actions. It's ridiculous for anyone to blame the bar, or the bartender - you could have just chosen not to drink, but you failed to do so. If you want to be treated like an adult, act like one - if not, check yourself in to a permanant daycare where someone can change your diaper and spoon feed you......

I think we have a little attention seeker on our hands!
At the end of the day you got no one to blame but yourself. You obviously knew you were on medication and everyone knows its not good to drink whilst taken them. You dont need to be a brain surgeon to work that one out. Whether the bartender knew is irrelevant in respect to your medication. In the UK selling a drunk person is illegal as with most places but they could easily say they didnt know your were on anti-de so there goes your court battle with sueing them. Your responsible for yourself and from my point of view I wouldnt trust you with anything. So stop whinging and deal with the fact you were wrong and go change your diaper!

| Whether you are able to sue or not in a situation like this you are better off taking it as a lesson and not drinking while you are on medication anymore...it was an irresponsible move for the bartender to push a drink on you if that was the case but if you are old enough to drink in a bar then you are an adult and are held responsible for your decisions...I am sorry to hear about your traumatic experience but chalk it up as a mistake and save your karma for when you have to sacrifice for your family someday |
